Terms of Service

These Terms of Service ("Terms") govern your use of the CookCardz app and any related services (together, the "Service"). The Service is operated by WRTHWHILE (ABN 71 181 136 188), a registered Australian business based in New South Wales ("we", "us", "our"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

CookCardz is built for everyone - including kids cooking with a parent or guardian. If you are under the age required to consent to online services in your country, please use CookCardz with a parent or guardian who agrees to these Terms on your behalf and takes responsibility for your use of the Service.

Some features require an account or a paid subscription. You're responsible for keeping your account details secure and for any activity under your account. Subscription pricing, billing cycles and cancellation terms are shown to you before you subscribe and are managed through our payment provider.

Subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation stops future renewals and your access continues until the end of the current billing period. Refunds are handled under our Refund Policy.

Recipes, photos, instructions and other content in CookCardz are licensed to you for personal, non-commercial use. You may cook them, share them with friends and family, and have a great time - please don't republish, resell, or use our content to train machine learning models without our written permission.

Cooking involves heat, sharp tools and ingredients that some people are allergic to. You're responsible for cooking safely, supervising children, and checking ingredient labels for allergens.

CookCardz is provided as a helpful guide only and does not provide medical, dietary or nutritional advice. Any dietary labels or filters (such as "Gluten Free", "Low GI", "Diabetes Friendly" or "Easy to Chew") are intended as general guides based on CookCardz's internal recipe criteria. They are not a substitute for advice from your doctor, dietitian, speech pathologist or other qualified health professional. If you have a medical condition, allergy, swallowing disorder or specific dietary requirements, you should seek professional advice before relying on these labels.

Don't misuse the Service: no reverse engineering, no scraping at scale, no using CookCardz to harm others, no attempting to bypass paywalls or security controls, and no uploading anything illegal or harmful if user uploads are ever enabled.

We may add, change, or remove features over time as we improve CookCardz. We'll try to give reasonable notice of meaningful changes, especially anything that materially affects a paid subscription.

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We don't guarantee the Service will always be available, uninterrupted, timely, or error-free. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill arising from your use of the Service.

Where our liability cannot be excluded but can be limited, our total aggregate liability to you in connection with the Service is limited to the total amount you paid us for the Service in the 12 months immediately before the event giving rise to the claim.

These Terms are governed by the laws of Australia. You and we each submit to the non-exclusive jurisdiction of the courts of Australia for any dispute arising out of or in connection with these Terms or the Service.
